Wedding Photography and/or Videography Terms & Conditions
This agreement contains the entire understanding between the Photographer/Videographer (otherwise referred to in this agreement as "Dover Media Group") and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.
Booking Fee / Deposit Payments
A non-refundable booking fee of 25%, as well as full acceptance of the terms and conditions as detailed below, secures the time and services of the Dover Media Group for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Service Provider due to cancellation. The booking fee will be deducted from the cost of the Client's chosen package when calculating the final balance due. Payment in full of the remaining balance will be due one calendar month before the wedding day. Weddings that are postponed to a later date will retain the fee as long as Dover Media Group can reschedule for the new date and time.
Second Photographer/Videographer/ Assistants
Dover Media Group has the right at all times to bring a second photographer/videographer or assistant to any event to aid the production of the photographs or video footage. The second shooter has all the same rights within this contract as the primary Service Provider. Some but not all images or footage shot by the second shooter may be used in collaboration with the primary Service Provider’s work to be part of the delivered package. Additionally, all images or footage taken by the second shooter shall become the property of the primary Service Provider, and the relevant copyright laws are still upheld.
Wedding Arrangements
The details of the wedding arrangements are to be agreed upon beforehand in writing (email is acceptable). The Client shall notify Dover Media Group of any changes to these details in writing. Dover Media Group cannot be held liable for delays or disruptions in the delivery of the service until any changes are received and acknowledged in writing.
Footage/Photography Quantity
Dover Media Group will deliver the agreed number of images or minutes of video footage as dictated by the Client's chosen package within 8 weeks of the wedding date. However, if delivery quantity is delayed for reasons outside Dover Media Group's control (e.g., uncontrollable circumstances like guest absence, weather disruptions, etc.), Dover Media Group will do their best to deliver the agreed quantity but accepts no responsibility for any shortfall. All images or footage, original or edited, shall be kept for 3 months from the wedding date. Any corrections, reprints, or duplicate copies must be requested before this time. It is the client’s responsibility to save, back up and protect your files from here. Following this period we are not required to hold your images or footage and it shall be removed from our systems.
Album Design/Video Editing
If a free wedding album is included within your chosen package, production will commence once all the images have been selected by the client. Image selections must be completed within 1 month to qualify for any free albums. The final product may take up to six weeks to deliver. Dover Media Group cannot be held responsible for any delays. Dover Media Group's artistic judgment regarding editing style shall be deemed correct.
Co-Operation
The Client will be responsible for, or have someone designated to, identify people of whom specific shots or footage are desired.
The Schedule
Both Dover Media Group and the Client agree that punctuality and cooperation are essential. A good faith effort will be made to capture any requested photographs or footage, but due to the rapid pace and unpredictable nature of weddings, it is impossible to guarantee that specific requested shots or footage will be captured.
Artistic License
Dover Media Group(s) shall be granted artistic license, and their judgment regarding photographing, filming, lighting, locations used, and editing shall be deemed correct. All decisions made are in the best interest of the Client, who will be given the highest quality selection from the images or footage taken.
Paparazzi Wedding Guests
Dover Media Group (and any assistants) is to be the sole and exclusive professional photographer(s)/videographer(s). It is understood that wedding guests will want to take their own photos or videos of the Bride and Groom; however, Dover Media Group must be given precedence over your guests in order to capture the required wedding images or footage. Dover Media Group cannot be held responsible for a lack of photos or footage if guests taking their own images or videos of the Bride and Groom have interrupted Dover Media Group’s work.
Content creators
Dover media group supports working with professional quality fellow suppliers, photographers or videographers to maintain the professional etiquette of your special day however does not work with “content creators”. Irrespective of how they describe their services.
If on the day we arrive at the event and a content creator is present or arrives later while we will do our best to work around them but not in conjunction with them or lead them.
Additionally content creators WILL NOT put microphones on people during ceremonies or speeches while we are doing videography ourselves nor will they add any additional lighting to any scene that directly affects our work. Dover media group will not edit content creators, nor any of their artifacts out of our images or films It is agreed that they will not impede on our work, shoot material that we set up or arrange including confetti moments group shots and portraits sessions. Any moments lost due to unexpected content creator interference or presence is the responsibility of the client. Should they choose to work in an unprofessional manor, dangerously, Illegally, or excessively disrupting to our work in exceptional circumstances we reserve the right to for fit further service on the day, deliver only what has been captured with no refund option.
Fellow Suppliers.
Dover media group guarantee to be appropriately insured and make available to the client any liabilities / pat tests, or certifications we needed for your event, it is the clients responsibility to pass these to your venue if needed or pass our details on to them so they can request these well in advance of the wedding date. We will not be held responsible if your venue has discrepancies or specific insurance requirements that we do not carry if we are notified in an unrealistic time frame to make necessary changes. Additionally, It shall be the responsibility of the client to ensure all fellow suppliers of your event carry the appropriate insurances. Any excessive damage to our equipment caused by fellow suppliers’ negligence that we cannot recover from them shall then be the responsibility of the client.
Unprofessional DJ Equipment
If the DJ at the wedding uses equipment detrimental to the photographer’s equipment, such as lasers that do not meet correct trade specifications and usage guidelines, Dover Media Group will make every effort to work with the DJ to have them turned off or corrected. However, if the DJ refuses to comply, Dover Media Group will be forced to turn off their cameras and stop taking photos or filming, These lasers can cause irreparable damage to photography equipment. Dover Media Group will not be held liable for any missed moments due to this issue.
Unruly Guests
If any guests at the wedding behave in an unruly manner and damage Dover Media Group's equipment, the cost of the insurance excess will be passed back to the Client. The Client will be responsible for reimbursing Dover Media Group for any damages caused by their guests.
Album/Book Selection
If a free wedding album or book is included within your chosen package, the Client must select the photos for the album within 30 days of receiving the image gallery. Failure to do so will result in the forfeiture of this product from the package, and no refund will be provided for the album or book.
Cancellation
The Client may cancel this contract at any time by giving written notice to Dover Media Group(s), but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.
Display
By entering into this contract, the Client(s) automatically grants Dover Media Group consent to use any images or video footage covered by this contract to promote the business in advertising, brochures, magazine articles, websites, social media, sample albums, sample videos, etc. The Client can revoke this agreement at any time but understands this does not guarantee removal of already used images in print, or where else unreasonable, details of which can be found in Dover Media Group's Privacy Policy, which is available on www.dovermediagroup.co.uk.
Image/Video Quality
All images and video footage will be supplied in high resolution digitally via web hosted gallery and memory stick. Dover Media Group will provide a pleasing colour balance but cannot guarantee exact colour matching due to technical limitations and differences in screen displays.
House Rules
Please note that photographers and videographers are sometimes limited by rules imposed by registrars, ministers, and venue management as to what can and cannot be done. For example, some ministers may insist that no flash photography or extra lighting is allowed, or that Dover Media Group can only work from a specific location. In such circumstances, the Bride and Groom agree to accept the technical limitations that may be imposed on the equipment used. It is advised that the Bride and Groom make themselves aware of the rules of the venue and, if necessary, negotiate with the personnel concerned. The area from which Dover Media Group is able to cover the ceremony may not be Dover Media Group's choice, and they cannot accept responsibility for any obstructed view should this be the case.
Raw images and editing finish.
Dover media group do not deliver RAW images or video files. Nor do we deliver every image taken.
All images and video will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer's judgment regarding these corrections and the number of images put forward to the Client shall be deemed correct. Excessive retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost. In addition, the photographer does not allow and further editing to his work by any person including the client(s) without prior consent in writing from the photographer. Editing includes colour, exposure, transforming, filters, etc. anything that changes the image from how it was delivered is classed as editing. All images are edited on a colour calibrated screen, and the photographer accepts no responsibilities for colour variation on displays after the images are delivered.
External factors.
Many factors in venues affect the work of the photographer and videographer. While experienced and very able there are sometimes things that can’t be worked around. Venues with interference or noisy audio systems, flickering lights, Downlighters etc are all factors we can’t change, will work with to the best of our ability but it is accepted these factors can effect the delivered product or quality.
Copyright
English Copyright Law states that the copyright of all images and video footage remains with Dover Media Group. Dover Media Group grants the Bride and Groom permission to make copies of the images and videos under the following conditions: The images and footage taken by Dover Media Group are for personal use by the Bride and Groom and their friends and relatives. Selling, publication, or any commercial use of the images or videos is not allowed without prior permission from Dover Media Group. Dover Media Group withholds the right to share a selection of appropriate images or footage with the couple’s vendors for use in their own marketing.
Permits
The Client is responsible for acquiring all permits and necessary permissions for all locations on which Dover Media Group will be performing services.
Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, Dover Media Group will not be responsible for any images or footage that is not produced due to technical failure.
Attendance
In the unlikely event of the assigned Service Provider being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer/videographer to attend your wedding on our behalf to undertake the wedding photography/videography to his/her best ability, Dover media group shall make every effort to provide a replacement photographer/videographer of the same or greater standard than ourselves at no additional costs to the client.
Capture & Delivery
Dover Media Group is not liable to deliver every image or minute of footage taken at the event. The determination of images or footage delivered to the Client is left to the discretion of Dover Media Group.
Photographer/videographer Breaks
The Photographer although only human shall not take photographs of people eating and shall use this time to eat with the wedding guests. Any other short breaks the photographer uses during the day for rest are entirely at his own discretion and shall not affect the images being caught nor taken during periods where his attendance is vital.
Personal Accident
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said person’s own risk. Every participating person has an obligation to protect their own safety at all times, The photographer cannot be held responsible for any personal accidents during a photographic shoot or filming.
Limitation of Liability
In the unlikely event of a total photographic or videographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of this contract. Neither party shall be liable for indirect or consequential loss.
